Acceptable Use Policy
Guidelines for responsible and lawful use of our service
This page outlines the Acceptable Use Policy (“AUP”) for the internet access service (the “Service”) provided by WNM Communications. Your use of the Service is contingent upon your agreement to abide by this AUP each time you access the Service.
By using the Service, you (the “User”) acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this AUP. WNM Communications reserves the right to revise this AUP at its sole discretion and without notice.

1. Access to Service Your access to the Service is at the sole discretion of WNM Communications. Access may be blocked, throttled, suspended, or terminated at any time for any reason, including but not limited to:
Violations of this AUP.
Actions that may impose liability on WNM Communications.
Activities that disrupt the Service or access for other users.
Violation of any applicable local, state, federal, or international laws, regulations, or ordinances (“Laws”).
2. Acceptable Use of Service WNM Communications supports the free flow of information and ideas over the Internet. The Service should be used in a legal, ethical, and responsible manner. While WNM Communications has no obligation to monitor user activity, your access is contingent upon legal and appropriate use of the Service.
3. Prohibited Use of Service The following activities are expressly prohibited and are considered a material breach of this AUP. Engaging in these acts may result in the immediate suspension and/or termination of your Service.
Illegal and Fraudulent Activities: Using the Service for any purpose that violates applicable Laws. This includes, but is not limited to: advertising, transmitting, or making available Ponzi or pyramid schemes; credit card fraud; software piracy; or making fraudulent offers to sell or buy products, items, or services.
Infringement of Intellectual Property Rights: Engaging in any activity that infringes or misappropriates the intellectual property rights of others. This includes copyrights, patents, trademarks, service marks, trade secrets, or other proprietary rights. This prohibition extends to the unauthorized use, reproduction, or distribution of any content, including software, music, and videos.
Spamming and Unsolicited Communications: Sending unsolicited bulk and/or commercial messages (“spam”). This includes, but is not limited to, commercial advertising, informational announcements, and political tracts.
Network and System Security Violations: Accessing or attempting to access computers, accounts, equipment, or networks belonging to another party without authorization.
This includes “hacking,” port scans, stealth scans, credential stuffing, brute-force attacks, or any activity that may be used as a precursor to an attempted system penetration.
Distributing or creating internet viruses, worms, Trojan horses, spyware, malware, ransomware, pinging, flooding, mail-bombing, or engaging in denial-of-service (DoS) attacks.
Harmful and Abusive Content: Transmitting, posting, or otherwise making available any content or language that is unlawful, abusive, harassing, defamatory, threatening, or obscene.
Obscene or Indecent Materials: Advertising, soliciting, transmitting, or otherwise making available obscene or indecent images or materials. WNM Communications will notify law enforcement of any suspected use of the Service in connection with child pornography, child solicitation, or related crimes.
Harassment and Doxing: Using the Service for activities that invade another’s privacy, including the unauthorized publication of an individual’s private and identifying information (“doxing”).
Malicious Synthetic Media: Creating or distributing “deepfakes” or other maliciously manipulated audio or video content intended to harm, defame, or deceive.
Misrepresentation and Impersonation: Forging, removing, or modifying identifying network header information (“spoofing”) to deceive or mislead. This also includes impersonating any person or entity or misrepresenting your affiliation with any person or entity.
Misuse of Company and Network Resources:
Unauthorized Resale: The sale, transfer, or rental of this Service to any third party without the express written consent of WNM Communications.
Excessive Resource Consumption: Using the Service for activities that consume excessive network resources and disrupt the experience for other users. This includes, but is not limited to, operating unauthorized servers or engaging in unauthorized cryptocurrency mining.
Facilitating Violations: Advertising, transmitting, or otherwise making available any software, product, or service that is designed to violate this AUP. This includes facilitating the means to spam, initiating denial-of-service attacks, or circumventing network security.
Export Control Violations: The transfer of technology, software, or other materials in violation of applicable export laws and regulations, including the U.S. Export Administration regulations.

Copyright Infringement (DMCA): WNM Communications complies with the Digital Millennium Copyright Act of 1998 (“DMCA”). If you believe in good faith that material on the Service infringes your copyright, you or your agent may send a notice requesting that the material be removed or access be blocked. DMCA notices should be directed to: noc@wnmt.com.
5. Disclaimer of Warranties and Limitation of Liability The Service is provided on an “as is” and “as available” basis. WNM Communications makes no warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, secure, or free of viruses.
Under no circumstances will WNM Communications or its affiliates be liable for any consequential, indirect, special, punitive, or incidental damages or lost profits arising from your use of the Service. The total aggregate liability of WNM Communications in any action shall not exceed one hundred dollars ($100).
6. Indemnification User agrees to indemnify and hold harmless WNM Communications and its affiliates from any claims, liabilities, losses, damages, or expenses (including reasonable attorney’s fees) arising from or related to the User’s use of the Service, violation of this AUP, or violation of any third-party rights.
7. Arbitration User agrees to submit any controversies or claims arising out of or relating to this AUP to the American Arbitration Association (“AAA”) for final disposition by compulsory arbitration under its commercial arbitration rules. Any such proceedings shall take place in Silver City, New Mexico.
8. General Provisions This AUP is governed by the laws of the State of New Mexico. This document constitutes the entire agreement between the User and WNM Communications regarding the use of the Service. If any provision of this AUP is held to be unenforceable, the remaining provisions shall remain in full force and effect.
