Network Management Policy

I. Introduction & Commitment

WNM Communications (“the Company”) has adopted the following network management practices, performance characteristics, and commercial terms for its broadband Internet access services. This policy is in compliance with the Federal Communications Commission’s (“FCC’s”) Open Internet Framework and is intended to help preserve the Internet as an open framework that enables consumer choice, freedom of expression, and innovation, while permitting the Company to manage its network reasonably.

The Company reserves all rights to manage its network, and this document does not waive any rights the Company may have to take actions necessary to protect the integrity of its network and the service for its users. The Company may add, delete, or modify this policy from time to time at its discretion. Notice of material changes will be provided on this website.

II. Network Management Practices

The Company manages its network with the goal of providing the best practicable broadband Internet experience to all its customers. The following practices are intended to be transparent and are applied in a non-discriminatory, application-agnostic manner.

  • A. Congestion Management: Congestion is an issue that can slow Internet activity during peak usage. The Company’s desired approach is to determine the source of congestion and increase the capacity of the affected portions of its network where warranted. However, network upgrades may not be instantaneous, as they can require coordination with third parties.

    • In the event of significant network congestion, the Company reserves the right to employ temporary traffic management practices. This management will be triggered by monitoring overall network utilization and is not based on the content, applications, or services being used.

    • This practice may involve identifying accounts using a disproportionate amount of bandwidth and temporarily managing their traffic until the period of congestion passes. During such times, affected users will still be able to access the Internet but may experience conditions such as longer times to download or upload files, slower web surfing, or increased latency in online gaming.

  • B. Application and Device Rules: Customers may use any lawful, compatible, and commercially available application or device, provided it does not harm the Company’s network, degrade service for other users, or facilitate the violation of any policy.

    • The Company does not have an approval procedure for devices. However, if the Company is contacted with a substantial allegation that a device or application being used is unlawful or harmful, it will investigate the matter. This investigation may include consultation with attorneys, regulators, or law enforcement agencies. The Company will take appropriate action to deal with any application or device that is demonstrated to be unlawful or harmful to the network.

  • C. Security Practices & Network Integrity: The Company employs commercially appropriate security procedures to protect its network, but cannot guarantee protection from all security threats. Customers are responsible for their own security and are encouraged to use anti-virus, anti-malware, and firewall software.

    • The Company does not monitor customer traffic for threats as a matter of course but reserves the right to block or limit traffic that is determined to be malicious or harmful to network integrity, such as spam, viruses, malware, or traffic associated with denial-of-service (DoS) attacks.

    • A customer subjected to a DoS attack or similar malicious activity is urged to notify the Company. We will work with the customer and, if necessary, law enforcement to address the matter to the extent that is technically and economically reasonable.

  • D. No Blocking or Paid Prioritization: The Company does not block any lawful content, applications, or non-harmful devices. The Company does not engage in paid prioritization or any practice that directly or indirectly favors some traffic over other traffic in exchange for consideration.

III. Performance Characteristics

  • A. Service Description & Performance: The Company provides Internet service over a hybrid network. The performance of this service is provided on a “best effort” basis. Actual access speeds and latency can be impacted by many factors, including those outside of the Company’s control, such as the user’s equipment, the capacity of third-party websites, and overall Internet congestion. Performance is not guaranteed.

  • B. Impact of Specialized Services: The Company may offer specialized services, such as VoIP. Heavy use of these services could potentially impact the capacity available for, and the performance of, your broadband service.

IV. Commercial Terms and Conditions

  • A. Pricing and Fees: For current pricing, early termination fees, and fees for additional services, please refer to the specific terms outlined in your service agreement and in the service offering details on our website.

  • B. Privacy: The Company does not inspect network traffic as part of its standard network management. The Company retains and provides customer information to law enforcement only as required by law (e.g., CALEA, FISA).

V. Middle Mile Grant Program Policy

This section applies specifically to facilities funded by the Middle Mile Broadband Infrastructure Grant Program (“MMG Program”) and is set forth in compliance with program requirements.

  • A. Interconnection: WNM Communications will provide access to MMG-funded facilities for interconnection at designated nodes on reasonable, non-discriminatory terms. We will negotiate in good faith with any party making a bona fide request for interconnection or wholesale services. Interconnection may occur at established WNM nodes, carrier hotels, and other technically and economically feasible locations.   • B. Nondiscrimination: WNM Communications does not block, throttle, or prioritize lawful content or applications on its MMG-funded facilities, except as necessary for reasonable network management and security. Wholesale customers are entitled to access the lawful Internet content of their choice and use any lawful device that does not harm the network.
